Wine.Pop Tom Voltz c/o RA Michael Voltz, Antonienstrasse 1, 80802 Munich, Germany (hereinafter referred to as ‘Wine.Pop’) publishes information/advertising for the promotion of wine tourism and the wine industry on the internet under various domains (e.g. ‘Winepop.travel’, ‘Winepop.events’) under the name "Wine. Pop‘ under various domains (e.g. ’Winepop.travel‘, ’Winepop.events‘) information/advertising for the promotion of wine tourism and the wine industry on the Internet, as apps for iPhone and Android smartphones, and in printed form. These terms and conditions refer to winepop.events, hereinafter referred to as the ’platform".
The platform mediates enquiries from companies to listed wineries and event locations (‘partners’). The platform's activity is limited to mediating qualified contact opportunities between interested parties and partners.
The lead fee is incurred in return for an independent referral service provided by the platform.
This includes, in particular, but is not limited to, the structured recording of the enquiry, its technical provision in the system, internal verification and allocation processes, and the controlled activation of the communication options provided by the interested party.
The lead fee is deemed to have been incurred as soon as
a. the partner accepts a request mediated via the platform in the system and
b. payment of the lead fee has been successfully completed via the payment processing provided by the platform.
Depending on the requirements specified by the interested party, the platform may simultaneously forward an enquiry to several partners who meet these criteria.
There is no entitlement to exclusivity.
Each partner accepts an enquiry independently.
A lead fee is only incurred for the partner who accepts the enquiry and successfully completes the payment.
The partner can accept, reject or ignore any enquiry in the system. If accepted, the lead fee is due for payment. After successful payment, the partner will be given access to all communication options provided by the interested party in the enquiry (e.g. email address, telephone number or similar contact details) for immediate and direct contact.
Once the communication options have been activated, the partner and the interested party are free to
communicate directly with each other,
negotiate all details such as services, dates, number of participants and prices,
submit offers or conclude or reject contracts.
The platform is not involved in these further steps and does not charge any commission on subsequent negotiations or bookings.
The partner undertakes to
If, after a request has been duly accepted, subsequent contact or follow-up requests are made by the same interested party outside the platform, no further fees will be charged for this.
In the event of violations of this regulation, the platform is entitled to
The partner is liable for the legal compliance of their publications. In particular, this includes the possible use of image, text, video or audio material or legally protected third-party trademarks, for which the Partner confirms that they have the necessary rights of use to publish them on the platform. The platform is not obliged to check whether the rights of third parties are affected. The Partner undertakes to indemnify the platform in the event of any disputes.
In order to promote the partner and the Wine.Pop platform, you expressly permit Wine.Pop to use your photos and other content on social media platforms such as Instagram, LinkedIn and others, as well as in other publications (including print). Wine.Pop publishes versions of photos to adapt them to the platforms' specifications regarding size and format.
Wine.Pop uses software from external service providers to translate the Partner's texts. Wine.Pop is not liable for the quality of the translations, but will of course quickly correct any errors that are reported.
The costs for translations are borne by the platform.
German law and, in particular, German data protection regulations apply.
In the event of legal action against Wine.Pop Tomas Voltz, the place of jurisdiction is Munich, Germany; in the event of legal action against the partner, the place of jurisdiction is their place of residence or business.
If any provisions of these rules are invalid, they shall be replaced by a valid provision that the parties would have reasonably chosen to achieve the purpose of their agreements had they been aware of the invalidity of the provisions. The validity of the remaining provisions shall remain unaffected by the invalidity of individual provisions.
